Terms of Service
Last updated: July 2026
These Terms of Service ("Terms") govern your use of fatcatdata.com (the "Site"), operated by Fat Cat Data ("Fat Cat Data," "we," "us"). By using the Site you agree to these Terms. If you don't agree, don't use the Site — no hard feelings.
What the Site is
The Site describes our consulting services and sample builds, and gives you ways to contact us. Content on the Site — including descriptions of sample systems, methods, and outcomes — is provided for general information about our practice. It is not a product offer, not a guarantee of results for any engagement, and not professional advice for any specific situation. Descriptions labeled as example or representative outcomes are illustrative of a class of work, not a promise of identical results.
Consulting engagements are separate
Our actual consulting work — proof-of-concept and MVP engagements — is governed by separate written agreements negotiated per project, including scope, price, confidentiality, and intellectual-property terms. Nothing on this Site creates a consulting relationship, and nothing you submit through the Site obligates either of us to enter one. If these Terms and an engagement agreement conflict, the engagement agreement wins.
Your submissions
When you send us a project inquiry, you promise the information is yours to share and reasonably accurate. We treat inquiries as confidential as described in our Privacy Policy. Please don't submit trade secrets or highly sensitive data through the form — describe the problem at whatever level you're comfortable with, and we'll put confidentiality terms in place before the detailed conversation.
Intellectual property
The Site and its content — text, design, graphics, logos, and the Fat Cat mark — belong to Fat Cat Data or its licensors and are protected by intellectual-property law. You may view, link to, and quote the Site reasonably (with attribution); you may not scrape it wholesale, republish it as your own, or use our marks to imply endorsement. Intellectual-property ownership for engagement deliverables is defined in each engagement agreement — as our materials describe, our standard posture is that clients own what we build for them.
Acceptable use
Don't misuse the Site: no attempts to breach security, probe or overload infrastructure, submit malicious code, misrepresent your identity, or use the Site in violation of applicable law. We may block access that violates these Terms.
Third-party links
The Site may link to third-party sites. We don't control them and aren't responsible for their content or practices.
Disclaimers
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, Fat Cat Data will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, and our total liability for claims relating to the Site will not exceed one hundred US dollars. Liability arising under an engagement agreement is governed by that agreement, not by this cap.
Indemnification
You agree to indemnify Fat Cat Data against claims arising from your misuse of the Site or violation of these Terms.
Governing law
These Terms are governed by the laws of the state in which Fat Cat Data is organized, without regard to conflict-of-law rules, and disputes will be resolved in the courts of that state.
Changes
We may update these Terms from time to time. The current version, with its date, always lives at this page. Continued use of the Site after changes means you accept them.
